What a notice must contain

To be effective under 17 U.S.C. § 512(c)(3), your notice must include all of the following:

  1. A physical or electronic signature of the copyright owner or a person authorised to act for them.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material claimed to be infringing, with enough detail for us to locate it.
  4. Your address, telephone number and email address.
  5. A statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are authorised to act for the copyright owner.

What happens next

We acknowledge notices on receipt and act on valid ones within 7 business days. Where the claim concerns generated output, removal means preventing the pattern that produced it from being produced again.

Counter-notice

If material of yours was removed and you believe that was a mistake or a misidentification, you may send a counter-notice to the same address, containing your signature, identification of the material and its former location, a statement under penalty of perjury that you have a good-faith belief it was removed by mistake, and your consent to the jurisdiction of the appropriate federal court.

Repeat infringers

We terminate the accounts of repeat infringers. Note that misrepresenting material as infringing may make you liable for damages under 17 U.S.C. § 512(f).
